An NBA referee who was terminated for refusing to receive the Covid-19 vaccine successfully defended his $2.9 million judgment in a pension case before the Second Circuit, the court said on Thursday.
The referee experienced an unambiguous termination of employment that makes him eligible for pension benefits, the US Court of Appeals for the Second Circuit said in an unpublished opinion. The pension committee’s attempt to define termination as requiring that there be “no reasonable possibility” that he could return to work “strains the phrase’s ordinary meaning,” the court said.
