Monster Beverage 401(k) Fee Lawsuit Moves Forward in California

Participants in Monster Beverage Corp.'s $213 million 401(k) plan advanced their proposed class action challenging the plan’s administrative fees and investment menu.

Judge John W. Holcomb denied the beverage company’s motion to dismiss the lawsuit in an order docketed Tuesday in the US District Court for the Central District of California. His two-page order, issued following a May 16 hearing, didn’t include a written analysis of his reasoning.
