Marten Transport Ex-Worker Drops Health Plan Smoker Fee Lawsuit

An ex-Marten Transport Ltd. employee dropped his lawsuit accusing the trucking company of wrongly charging workers who smoke more for their health-care coverage than those who don’t, without offering a valid way to avoid the penalty.

The worker on Monday told Magistrate Judge Anita Marie Boor that he was voluntarily dismissing all his claims against the company without prejudice. His notice, filed in the US District Court for the Western District of Wisconsin, didn’t include further details about how the case was resolved.
