LTD Benefits Claim Remanded to MetLife

Metropolitan Life Insurance Co. acted arbitrarily and capriciously in subjecting a participant’s long-term disability benefits to 24 months under a policy limitation for neuromusculoskeletal and soft tissue disorders, the U.S. District Court for the Northern District of Ohio held Sept. 27, remanding the participant’s claim for benefits to MetLife for further consideration and awarding MetLife $24,235 in benefits overpaid to the participant (Arquilla-Romeo v. Metro. Life Ins. Co., 2013 BL 263986, N.D. Ohio, 4:12-cv-01779-JRA, 9/27/13).
