Lincoln National Life Insurance Co. wrongfully shortchanged benefits under its long-term disability plans by making improper offsets, according to a proposed class action filed by a litigator with Parkinson’s disease (Barber v. Lincoln Nat’l Life Ins. Co., W.D. Ky., No. 3:17-cv-00034-JHM-CHL, complaint filed 1/20/17).
The lawsuit, filed Jan. 20 in a federal court in Kentucky, claims that the disability insurer had a practice of reducing people’s benefit payments to account for other income they received, even though these offsets weren’t authorized by Lincoln’s disability plans.
