Liberty Mutual Retiree Loses Class Bid Over Health Plan Credit

A lawsuit over Liberty Mutual Insurance Co.'s retiree health plan failed to secure class action status because the plaintiff’s proposed class definition encompasses claims he didn’t include in his complaint.

The lawsuit seeks more generous benefits under Liberty’s retiree health plan based on the 28 years the plaintiff spent at predecessor Safeco Insurance Co., but his proposed class definition appears to include workers seeking benefits under the corresponding Safeco plan, Judge F. Dennis Saylor IV said.
