Airline meal provider Flying Food Group LLC resolved a Labor Department lawsuit claiming it mismanages its health plan and illegally charges higher premiums to employees who smoke.
Flying Food will restore $117,563 to its employee health plan for the benefit of workers who were improperly subjected to a deductible for certain medical services, according to an Aug. 30 agreement filed with the US District Court for the Northern District of Illinois. The company will also pay $16,600 to plan participants who paid higher premiums based on their tobacco use and pay a $13,422 penalty.
