Labcorp Workers Get Class of 55,000 in 401(k) Plan Fee Lawsuit

Labcorp workers challenging the fees associated with the clinical laboratory network’s $3.9 billion 401(k) plan convinced a federal judge to certify their case as a 55,000-person class action.

Labcorp objected to having the class certified, saying the named plaintiff couldn’t lead a class action because he knew nothing about the case beyond what he’d been told by his attorneys. Judge Loretta C. Biggs disagreed, saying plaintiff Damian McDonald demonstrated a “basic understanding of the facts of his case and an interest in the litigation” when he sat for a deposition.
