Labcorp Employee Wants Class of 55,000 in 401(k) Fee Challenge

A Labcorp worker suing the clinical laboratory network over fees tied to its $3.9 billion 401(k) plan asked a federal judge to certify his case as a class action covering more than 55,000 people.

The worker’s motion, filed March 1 in the US District Court for the Middle District of North Carolina, seeks a class covering all participants in the retirement plan for Laboratory Corporation of America Holdings since August 2016. The case centers on the company’s plan-wide conduct and doesn’t turn on any individual class member’s circumstances, according to the motion.
