The deal, which is expected to cover more than 40,000 people, represents about 22% of the plaintiffs’ highest estimated damages in connection with the plan’s recordkeeping fees. The amount reflects the company’s “strenuous arguments” that the participants weren’t harmed by the plan’s investments, according to the settlement motion.
