A provider of tens of thousands of Covid-19 tests lost its lawsuit seeking to force the US Department of Health & Human Services to make insurers pay the company, which says it’s owed more than $18 million.
Saloojas Inc. sought a court order requiring the department to enforce provisions in a pair of pandemic-era federal statutes aimed at expanding insurance coverage for Covid testing costs. Judge Edward M. Chen dismissed the lawsuit Thursday, saying federal agencies have discretion over their enforcement decisions.
