Consumer Data Partners LP advanced part of its lawsuit against the benefits administration company it tapped to provide health plan enrollment services for its partners, according to a federal court opinion dismissing some claims as preempted.
Consumer Data’s claim against Agentra LLC under the Employee Retirement Income Security Act’s equitable remedies provision is viable because it seeks appropriate relief authorized by the statute, Judge Jane J. Boyle of the US District Court for the Northern District of Texas said.
