Georgetown Beats D.C. Circuit Appeal Over Retirement Plan Fees

Georgetown University on Tuesday defeated an appeal by employees challenging the fees and investment options in a pair of the school’s retirement plans.

The employees’ proposed amended complaint was properly rejected as futile because it didn’t fix problems identified in prior court orders, the US Court of Appeals for the D.C. Circuit said. Some of the workers’ claims were correctly dismissed for lack of standing, and others were rejected as insufficient under the Employee Retirement Income Security Act, the appeals court said in an unpublished, two-page order issued two weeks after the case was argued.
