Gateway Bank Must Face Ex-CEO’s Lawsuit Over Retirement Benefits

Gateway Bank FSB’s former CEO advanced part of her lawsuit saying her monthly retirement benefits of $9,252 are less than half of what she’s owed.

Poppi Metaxas has a valid claim for benefits under the Employee Retirement Income Security Act based on a disagreement as to the amount owed to her under a supplemental executive retirement plan, the US District Court for the Northern District of California said Thursday. But Metaxas can’t seek interest or related tax withholding amounts without identifying the plan provision that would provide them to her, the court said.
