Franciscan Alliance Must Defend $320M Pension Lawsuit

A lawsuit claiming Midwestern health system Franciscan Alliance Inc. underfunded its pension plan by $320 million in allegedly misguided reliance on a religious exemption from federal pension law advanced.

A federal judge declined to dismiss the employees’ lawsuit, saying he needed more facts to determine whether Franciscan’s pension plan met the statutory definition of a “church plan” under the Employee Retirement Income Security Act. He also allowed the employees to move forward with claims of ERISA fiduciary breach and breach of contract under state law.
