Former professional football player Tyrone Keys can’t stop the NFL retirement program from clawing back $830,000 in disability benefits even though it waited more than a decade to seek the refund, the Middle District of Florida said.
The Employee Retirement Income Security Act doesn’t specifically allow equitable estoppel, so Keys can’t argue that the plan waived its claim to the money through delay, the court said.
Keys played in the NFL from 1983 until 1989 when he retired due to football injuries to his knees, back, and shoulder.
