Former NFL Player Can Seek Simultaneous ERISA Claims

A former National Football League player seeking to recover disability benefits got a second chance to properly allege that two NFL’s plans breached their ERISA fiduciary duties by allegedly mismanaging participants’ claim (Dimry v. Bert Bell/Pete Rozelle NFL Player Ret. Plan, 2016 BL 189406, N.D. Cal., No. 3:16-cv-01413-JD, 6/14/16).

Judge James Donato of the U.S. District Court for the Northern District of California dismissed June 14 Charles Dimry’s fiduciary breach claim under the Employee Retirement Income Security Act because he failed to allege sufficient facts.
