Expatriate Health Plans to Qualify Under ACA Rules

Health plans for U.S. citizens living abroad will qualify for the Affordable Care Act’s individual coverage mandate starting Jan. 1, 2017, according to proposed rules from the IRS and two other federal agencies.

Previous interim guidance allowed a taxpayer to apply elements of the Expatriate Health Coverage Clarification Act of 2014 until further guidance on the ACA was released.

Issuers of health plans for U.S. citizens living abroad don’t need to provide certificates of creditable coverage, according to the proposed rules (REG-135702-15, RIN:1545-BN44). Imposing that requirement “would be inefficient and overly broad, and relevant in only limited circumstances,” ...
