Ex-Ricoh USA Worker Loses Bid to Remand Overtime Lawsuit (1)

A former Ricoh USA Inc. technician can’t take his wage and overtime proposed class action back to state court since the suit is statutorily required to stay in federal court.

Saranay Sonny Ballungay’s lawsuit meets the diversity citizenship requirement of the Class Action Fairness Act and involves an amount above the $5 million threshold vesting federal courts with original jurisdiction, Judge Josephine L. Staton said in minutes from her chamber Monday, which were docketed the following day. Staton denied Ballungay’s motion to remand, leaving the suit in the US District Court for the Central District of California.
