Ex-NFL Cornerback Wins Another Chance for Disability Benefits

The National Football League’s retirement plan must reconsider a claim for disability benefits by retired cornerback Charles Dimry after a federal judge in California concluded that the plan committed “glaring procedural error” in handling Dimry’s claim.

The NFL plan denied Dimry a full and fair review of his claim, as required by the Employee Retirement Income Security Act, because it didn’t communicate with Dimry during the appeals process and because it wrongly required him to produce objective medical evidence supporting his subjective complaints of pain, Judge Jacqueline Scott Corley of the U.S. District Court for the Northern District of California ...
