The U.S. District Court for the Southern District of Florida declined Oct. 22 to dismiss several claims by medical providers that alleged three insurers violated the Employee Retirement Income Security Act (Sanctuary Surgical Centre Inc. v. UnitedHealthcare Inc., S.D. Fla., 9:10-cv-81589-DTKH, 10/22/12).
The medical providers alleged that the insurers violated ERISA by granting preapproval for a specific medical procedure and then denying coverage after the procedure was performed on patients. The medical providers asserted causes of action for wrongful denial of benefits, breach of fiduciary duties, failure to provide plan documents, and equitable estoppel.
