Eli Lilly Pulls Fee Request in 401(k) Suit; Worker Waives Appeal

Eli Lilly & Co. withdrew its bid to force an employee who sued over the company’s 401(k) plan to pay $86,000 in attorneys’ fees and costs after her proposed class action was dismissed.

The company’s notice, filed Tuesday in the US District Court for the Southern District of Indiana, doesn’t identify a reason for the withdrawal. It was filed the same day plaintiff Jennifer Probst filed a notice informing the court that she had waived her right to appeal the ruling against her or otherwise seek reconsideration.
