DST Loses Bid to Disqualify Counsel from 401(k) Arbitrations

DST Systems Inc. lost its bid to disqualify Klamann Law Firm from representing three former members of the company’s 401(k) committee in arbitration actions challenging plan investments, after a Manhattan federal judge concluded that the federal court in Kansas City, Mo., was better positioned to make this call.

The ruling by Judge Andrew L. Carter Jr. comes eight months after Carter disqualified Missouri-based Klamann from representing DST 401(k) plan participants in a pair of lawsuits pending in his courtroom in the U.S. District Court for the Southern District of New York.
