Drug Benefit Managers Want Another State Law Struck

The Pharmaceutical Care Management Association is looking to extend its streak of successful challenges to state drug pricing laws in the Eighth Circuit.

The PCMA wants the court to strike down a North Dakota law limiting how companies like Express Scripts, CVS Health, and UnitedHealth Group profit from prescription drug sales. The PCMA successfully challenged similar laws in Iowa and Arkansas, with the Eighth Circuit finding both states’ laws preempted by the Employee Retirement Income Security Act.

Arkansas recently asked the U.S. Supreme Court to review the decision striking down its drug pricing law.
