A class of more than 200 physicians can go to trial on claims that UnitedHealth Group Inc. wrongly adopted a blanket policy refusing to pay facility fees for office-based surgeries, a federal judge in Manhattan ruled.
The Medical Society of the State of New York can move forward with claims that UnitedHealth’s “uniform refusal” to pay facility fees contravened the terms of its health plans, according to a ruling issued Thursday by Judge J. Paul Oetken of the U.S. District Court for the Southern District of New York.
