DISH Network Beats Would-Be Class Suit Over 401(k) Fees, for Now

DISH Network Corp. defeated a proposed class action challenging the fees and investment options in the company’s $841 million retirement plan.

Judge Christine M. Arguello on Monday adopted a magistrate report recommending that the Employee Retirement Income Security Act lawsuit be dismissed. Arguello agreed with Magistrate Judge Scott T. Varholak that the allegations of excessive administrative fees were based on inappropriate comparisons between the DISH plan’s average fees over a five-year period and a single-year snapshot of the fees paid by other plans.
