Corteva’s E.I. du Pont Sued Over Married Worker Pension Math (1)

An E.I. du Pont de Nemours & Co. retiree filed a proposed class action accusing the Corteva Inc. subsidiary of improperly shortchanging the retirement benefits of workers who choose pensions that make post-death payments to their surviving spouses.

The lawsuit challenges how certain benefits are calculated under the DuPont Pension & Retirement Plan, which provides benefits to more than 55,000 retirees. According to plaintiff James Manning, the plan uses decades-old life expectancy data to calculate pensions that include surviving spouse payments, causing these pensions to be improperly reduced compared to the traditional, single-life annuities available under the plan.
