Cornell Workers Get Boost in SCOTUS-Revived Retirement Plan Suit

Cornell University employees who’ve been litigating over their retirement plan for nearly a decade can conduct additional discovery, a district judge ruled in the aftermath of a US Supreme Court opinion reviving the lawsuit.

The parties can engage in additional fact and expert discovery and present arguments over whether the case should be tried by a jury, Judge P. Kevin Castel said in a scheduling order issued Thursday in the US District Court for the Southern District of New York. Cornell opposes a jury trial and had argued against reopening discovery.
