Continental Automotive Pension Lawsuit Gets Class Treatment

Continental Automotive Inc. workers won class certification of their lawsuit alleging the company underpaid them pension benefits (West v. Cont’l Auto., Inc., W.D.N.C., No. 3:16-cv-00502-FDW-DSC, 6/7/17).

A federal judge on June 7 gave class action status to about 60 participants and beneficiaries in Continental’s pension plan. Their lawsuit claims that the German auto parts manufacturer with operations in North Carolina miscalculated workers’ benefits by failing to give them pension credit for periods when they were laid off. The workers say this violated the terms of Continental’s pension plan and federal law.
