ConocoPhillips Scores Trim of Pension Miscalculation Lawsuit

A former ConocoPhillips Co. employee who accused the company of misleading him about the size of his pension can proceed with part of his Employee Retirement Income Security Act lawsuit, an Alaska federal judge ruled.

Monte Mabry’s lawsuit, which claims ConocoPhillips consistently overestimated his pension benefits by hundreds of thousands of dollars, lacks a viable claim for fiduciary breach under ERISA, Judge Sharon L. Gleason of the U.S. District Court for the District of Alaska said Tuesday.
