Conflict Exists in Guardian’s Benefit Denial

Guardian Life Insurance Co. of America is not entitled to summary judgment in a participant’s action appealing a long-term disability benefit denial because a genuine dispute exists after Guardian credited a single examination from its own independent medical examination that contradicted multiple reports from the participant’s treating health care providers, the U.S. District Court for the Northern District of California ruled May 18 (Tarasovsky v. Stratify Inc., N.D. Cal., 3:11-cv-03359-WHA, 5/18/12).
