Comcast Worker Seeks SCOTUS Input on ERISA Plan’s Choice of Law

A Comcast Corp. worker who unsuccessfully sued Liberty Life Assurance Co. of Boston for disability benefits is calling on the U.S. Supreme Court to take his case and explain when an otherwise applicable state law can be displaced by an ERISA benefit plan’s choice-of-law provision.

Michael Ellis wants the justices to resolve a “three-way circuit split” on how courts determine when a choice-of-law provision in a benefit plan governed by the federal Employee Retirement Income Security Act can override a state law that would otherwise apply.
