COBRA Notices Lawsuit Proceeds Against Wisconsin Food Supplier

Milwaukee-based produce distributor V. Marchese Inc. will face a putative class of employees who accuse the company of violating the Consolidated Omnibus Budget Reconciliation Act, after a federal court refused to dismiss claims based on the statute of limitations.

Marchese was sued Oct. 10 in the Eastern District of Wisconsin by a former employee who said the company doesn’t properly notify workers of their right to continue coverage in the company’s health plan after leaving their jobs.
