Clean Harbors Ordered to Face Suit Over Retirement Plan Fees

A Clean Harbors Inc. unit must defend a proposed class action by a former employee who says the waste management company’s retirement plan was plagued by needlessly expensive investments and high-cost stable value funds.

Judge George A. O’Toole Jr. allowed the case to advance in an electronic order docketed Thursday in the US District Court for the District of Massachusetts. O’Toole explained that claims of fiduciary imprudence under the Employee Retirement Income Security Act are “context specific,” and that judges weighing a motion to dismiss must assume that all facts asserted in the complaint are true.
