Cintas Wants 401(k) Fee Lawsuit Sent to Arbitration

Cintas Corp. wants a lawsuit over the company’s 401(k) plan moved to arbitration, telling a federal judge in Ohio that the proposed class action is blocked by the plaintiffs’ employment agreements.

Former Cintas employees Raymond Hawkins and Robin Lung signed employment contracts with arbitration agreements expressly covering claims under the Employee Retirement Income Security Act, Cintas said in a motion filed Tuesday.

These agreements are valid and enforceable, as are the contract provisions requiring Hawkins and Lung to arbitrate their claims on an individual basis, and not as representatives of a class, Cintas said.
