Cigna Scores Partial Revival of Medical Lab Fraudulent Bill Suit

Connecticut General Life Insurance Co. will get another chance to sue laboratory testing companies over more than $17 million in allegedly fraudulent bills after the Second Circuit held Wednesday that the insurer’s federal claims weren’t barred by Connecticut’s three-year deadline to sue.

Cigna’s claims under the Employee Retirement Income Security Act and the Declaratory Judgment Act aren’t subject to a statute of limitations and shouldn’t have been dismissed as untimely, the U.S. Court of Appeals for the Second Circuit held.
