Cigna Can’t Duck Family’s Suit Over Provider List Confusion

Cigna Group must face portions of a family’s lawsuit saying the insurer breached its fiduciary duties by failing to maintain a up-to-date list of in-network medical providers.

The family has a viable fiduciary breach claim based on Cigna’s alleged failure to resolve a dispute over a hospital’s in-network status that allegedly caused them to face unwarranted medical bills, Judge Manish S. Shah said Thursday. But the family’s claim for wrongfully denied benefits under the Employee Retirement Income Security Act fails, the judge said, because Cigna correctly paid their benefits according to the terms of their health plan.
