Chamber Decries ‘Catch-22' of Centene Worker’s 401(k) Lawsuit

The US Chamber of Commerce backed Centene Corp. in its effort to defeat litigation over its 401(k) plan, calling the lawsuit the “poster child” for meritless ERISA cases designed to force settlements.

The lawsuit is an improper attempt to game a recent US Supreme Court decision making it easier for workers to bring prohibited transaction claims under the Employee Retirement Income Security Act, the chamber said Monday in a motion requesting permission to file an amicus brief in the case.
