A federal district court in Pennsylvania granted UPMC Health Plan Inc. and University of Pittsburgh Medical Center summary judgment on out-of-network provider Abira Medical Laboratories LLC’s breach of contract and unjust enrichment claims, and granted Abira summary judgment on UPMC’s counterclaims for unjust enrichment and quantum meruit. According to the court, the claims and counterclaims are time-barred.
