A federal district court in New York granted Aetna Health and Life Insurance Company’s motion to dismiss Rowe Plastic Surgery of New Jersey LLC’s action for breach of contract, promissory estoppel, unjust enrichment, fraudulent inducement, and violation of the N.Y. Prompt Pay Law, relating to payment for a patient’s bilateral breast reduction. The court granted Rowe 30 days to file a second amended complaint that repleads breach of contract, promissory estoppel, unjust enrichment, and fraudulent inducement.
