A federal district court in California granted in part and denied in part Cigna Behavioral Health Inc. and Viant Inc.'s motions to dismiss this putative ERISA class action suit alleging failure to reimburse covered mental health provider claims at the usual, customary, and reasonable rates. The class representative brought suit on behalf of her beneficiary son, alleging that Cigna and Viant conspired to underpay claims for out-of-network mental health treatments. The court rejected claims for failure to provide plan documents and RICO violations, but held that claims for ERISA plan benefits and breach of fiduciary duties can go forward.
