A federal district court in New York granted in part and denied in part the Chairman of the Joint Industry Board of the Electrical Industry’s motion to remand and for leave to amend this ERISA and Labor Management Relations Act action against Structure Tone LLC, brought on behalf of various multi-employer benefit funds alleging liability for a subcontractor’s unpaid contributions. The court denied the motion to remand and granted the motion for leave to amend as to the claims against the non-party subcontractor, but denied the motion as to the claims against Structure Tone.
