A federal district court in Nevada denied Hometown Health Providers Insurance Company Inc. and Hometown Health Plan Inc.'s motion to dismiss Prime Healthcare Services – Reno LLC’s action alleging failure to pay or underpayment for medically necessary out-of-network services provided to patients insured by Hometown Health. The court said that Prime Healthcare demonstrated standing to sue Hometown Health and sufficiently pleaded its ERISA, breach of contract, breach of implied-in-fact contract, quantum meruit/unjust enrichment, and Nevada Emergency Care and Nevada Prompt Payment statute claims.
