A federal district court in Ohio granted the Guardian Life Insurance Company of America’s motion to transfer an Aurora Flight Sciences manager’s ERISA action challenging the denial of long-term disability benefits to a federal district court in West Virginia. According to the court, Ohio isn’t Guardian’s place of incorporation or principal place of business, and the manager hasn’t pointed to any exceptional circumstances or shown sufficient minimum contacts. And the court said that the manager resides in West Virginia, was denied benefits when residing there, and could have brought the case in West Virginia.
