Case: Health Care & Benefits/Long-Term Disability Benefits (N.D. Cal.)

A federal district court in California granted Life Insurance Company of North America’s motion to dismiss a PricewaterhouseCoopers LLP partner’s claims for breach of contract and breach of the implied covenant of good faith and fair dealing, in his action challenging the denial of long-term disability benefits. According to the court, the policy is covered by ERISA, so the partner’s state law claims are preempted.
