A federal district court in Kentucky granted Aetna Life Insurance Co.'s motion for judgment on the pleadings in an Amazon Corporate LLC employee’s action challenging the termination of her long-term disability benefits. The employee was diagnosed with sarcoidosis through biopsy, in addition to severe persistent asthma, chronic fatigue, chest pain, dyspnea on exertion, mediastinal adenopathy, and obstructive sleep apnea. According to the court, the totality of the evidence establishes that the employee can perform at least some gainful activity, so she doesn’t meet Amazon’s employee welfare benefit plan’s test of disability.
