The District of Maryland granted Unum Life Insurance Company of America’s partial motion to dismiss an employee’s ERISA action challenging the denial of her long-term disability benefits relating to post-concussion syndrome and migraines sustained from a motor vehicle accident. According to the court, the employee can’t claim a private right of action or a breach of fiduciary duty action on behalf of herself, and she failed to state a viable claim for equitable relief.
