A federal district court in Texas denied Health Care Serv. Corp.'s motion to dismiss for lack of subject matter jurisdiction Texienne Physicians Medical Association PLLC’s ERISA and breach of contract action alleging underpayment for health care services, and granted in part and denied in part its motion to dismiss for failure to state a claim. The court said that to the extent any assigned medical claim is subject to ERISA, Texienne’s contention that it procured assignments from the patient-beneficiaries is plausible.
