A federal district court in Washington granted Northwest Administrators Inc. summary judgment in its ERISA action against Columbia Ford Hyundai Inc. for delinquent contributions. Northwest is the authorized administrative agent and assignee of the Washington Teamsters Welfare Trust, and Columbia and a local teamsters union signed subscription agreements in which Columbia agreed to be bound by collective bargaining agreements. According to the court, there’s no genuine dispute of material fact on the issue that the plan documents required Columbia to make contributions of $650 per qualifying employee, whether or not that employee decided to accept coverage.
