A federal district court in Michigan granted in part and denied in part Blue Cross Blue Shield of Michigan’s motion to dismiss an individual’s claims for breach of the Mental Health Parity and Addiction Equity Act and breach of contract, based on its refusal to cover the costs of his partial hospitalization at an out-of-network residential facility. The court denied the motion to dismiss as to the MHPAEA claim, but said that the contract law claim is preempted by ERISA.
